I am not sure exactly what you mean by not following the Constitution. This is erroneous if you are implying that illegals have the same rights under the Constitution that citizens do.
Obviously, the 5th and 14th amendments sets up the due process part.
The illegals are handled under what is termed the ‘procedural due process’.
That part of the Constitution has always been followed in the past, akan is followed today.
We know that the 18 U.S.C. 1325 is being broken when they enter illegally, or come here and then stay illegally.
So, ICE has been set up, in part, to control this and to detain and apprehend those that are breaking this.
So, if things were not following the Constitution they would have been in courts many times already for not doing so.
The issue is that this has been going on for a long time.
Like I said above: If you look at the data points, the arrests that ICE made last year was roughly 1700 — about the equal to what we have seen in the previous years.
And:
Over the 6500+ arrests made while Biden was in office — not once did any of these officials complain that ICE was making the streets unsafe.
If you go all the way back to how Eisenhower handled it you would see a much more extreme example of this. This was known as ‘Operatinon Wetback’ — that is not politically correct to call it that nowadays. But you can go back and look up how he handled it.
So, it is not a matter of this administration not following the Constitution, it is not that they are doing it at unprecedented numbers, and it is not that they are doing it in any different manners.
The issue is that it is Trump doing it now.
Certainly Trump could be more tactful about how he talks about it.
But you have to keep in mind this was one of the top 2 reason he was elected the first time, then it was probably the top reason he was not reelected, then it was one of the top 2 reasons he was elected this time.
Anytime you start a discussion about an issue you have to start where you diverge in the discussion. You have to take it back to there. You cannot start arguing about how they are removed if you do not go back to the beginning and ask if they should have been allowed in to start with.
This is the root of the problem, the Right does NOT want illegals allowed in; the Left does not only WANT them allowed in — they encourage it.
Then you have to ask if that is Constitutional — and it is not.
Then you have to ask why the Left wants them allowed in. That is a whole other discussion.
